GENERAL TERMS AND CONDITIONS OF THE PROGRAM

1. The Program

Cozy Loyalty Rewards (hereinafter the "Program"), is a Loyalty Program, owned by Cozy Punta Cana, Srl. With registered office at Avenida España, Villa Caracoles Condominium, 23000, Bávaro-Punta Cana, LA., Dominican Republic . (hereinafter the “Owner).

The Program will be governed by these general terms and conditions (Terms and Conditions) that are complied with, unless they are totally or partially replaced or complemented by specific particular conditions, in which case the latter shall prevail over the former.

2. Purpose of the Program

With this program we want to reward the loyalty of visitors who rent our Cozy Holiday Homes. However, it may happen that certain properties are excluded from the Program, this detail can be consulted at any time directly by sending an email to: customerservice@cozypuntacana.com.

3. Headlines

This program can be used by individuals who are legally of legal age, by signing as a sign of acceptance and sending the application for registration in it through telematic means (website, mobile application, etc ...) online and / or off-line enabled for these purposes. With your adhesion or application for enrollment in the Program, and once you have assigned an associated account number, you become the Holder of the same and accept without reservation these Terms and Conditions in accordance with the current clauses at all times.

Adherence to the Program attributes to the Holder of the same, the ownership of a personal account where points generated by stays or referrals that complete the reservation process at Cozy will be accumulated. The availability of this account is personal and non-transferable and will identify the Holder with his data and personal account number, empowering him to participate in the Program.

With the assignment of the number associated with the Account, from that moment the Client is enabled to benefit from the different possibilities and advantages offered by the Program in such condition. If, in addition, this Client performs the online activation for own account management, such circumstance attributes additional benefits. Each Holder may exclusively dispose of his Account and, consequently, the Owner reserves the right to unilaterally cancel any additional or parallel account that the Holder may have subsequently or at the same time obtained after the corresponding discount or redemption of points derived from welcome promotions, Duplicate stays or promotional vouchers that are not applicable in accordance with these Terms and Conditions. The transmission, sale, purchase, exchange or total or partial transfer, by any means, of an account and / or the points accumulated therein is prohibited, except for those expressly authorized in these conditions. Failure to comply with the above, enables the Owner to cancel and terminate those holders who have violated these prohibitions, without them having the right to be restored or compensated in any way.

The Account Holder will be solely responsible for the accuracy of the personal data provided to the Owner for enrollment in the Program, as well as the subsequent update thereof, using the different channels enabled for this. For these purposes, the Owner may contact and inform the Owner in writing (i) by mail, through the email customerservice@cozypuntacana.com attaching in any of these cases the documentation that proves said update.

4. Obtaining points for hiring stays and services

a) The Holders will accumulate points in their Cozy Loyalty Rewards account for each effective stay, that is, booked, paid and enjoyed in one of our Vacation Homes participating in the Program and operated by Cozy Punta Cana, Srl. If the points have not been duly paid, the Holder can directly demand said accreditation by sending the information of their stay in writing to our email: customersservices@cozypuntacana.com.

b) In no case will they generate points or accumulate points, or, where appropriate, nights or stays, in the following cases:

  • Stays paid for through and exclusively through redeemed or exchanged points.

  • For stays partially paid through points redeemed or exchanged and the rest with money, for the proportional part associated with the price that has been paid for such points exchange.

  • For stays when the holder stays with direct rates from OTAS (On-line Travel Agencies), TT. OO, Groups, Bonuses, Crews and programs outside of Cozy Punta Cana, Srl. Or in direct stays.

  • For stays and services contracted with Cozy Punta Cana, Srl. In properties included in the Program, when it does not specify that it generates the right to obtain points.

  • In the event that the amount of the invoice issued for the reason of the stay is not fully paid.

5. Criterion or calculation formula for obtaining points derived from the hiring of stays and services

The points obtained in the manner described in section 4 above of these terms and conditions will be accumulated in the Account of the Holder. Those stays prior to the date of enrollment in the Program, nor the first stay / night, as well as those reservations / registrations made directly at the Cozy Vacation Home will not generate points.

The accreditation of points will always be subject to the obtaining criteria in force at the time of their assignment, all as described in this regard in the Cozy Loyalty Rewards section of the website www.cozypuntacana.com.

In order to enjoy the benefits associated with their status within the Cozy Loyalty Rewards program, it is essential that, when wishing to redeem their points, the guest requests it directly through our email: customerservice@cozypuntacana.com, the data having to match of the reservation holder and those of the Program account holder.

Holders will accumulate the points obtained corresponding to the services automatically enjoyed in their account for the total amount of the reservation, before taxes and fees of any type that may be applicable in accordance with regulations, including the services that are detailed in it except of which will be mentioned later. The points will be credited to the account of each Holder within a period of approximately 3 to 4 weeks after the date of completion or termination of your reservation, and provided that said services have been paid effectively and in full, you will receive a message from our email: customerservice@cozypuntacana.com in which you will be informed about the amount of points you have accumulated to date.

The Holder enables and authorizes the Owner to correct or regularize any incorrectly made credit or redemption of points.

The benefits obtained in application of the conditions of the Program are not compatible or cumulative with those of other loyalty programs, unless the Owner determines otherwise.

6. Accumulation of Cozy Loyalty Rewards.

The points obtained will only be accumulated in the account of the Holder who has personally stayed in one of our Houses included in the Program or who has enjoyed the service for which he is entitled to obtain points, regardless of the individual or legal entity that proceeds. to the effective payment of the corresponding invoice, either the Holder himself or any of his companions, his company or travel agency.

In the case of points obtained for stays in our Cozy Holiday Homes included in the program, points will only be accumulated for a maximum of one (one) House (regardless of whether the reservation responds to a higher number), as long as Visitors staying in the other Houses do not have a Cozy Loyalty Rewards account.

If the visitors who occupy the other rented houses have a personal Cozy Loyalty Rewards account and inform them at the time of check in, the points generated by the reservation amount will be distributed equally among the Cozy Loyalty Rewards accounts.

In the event that the visitors who occupy the other rented houses are not a member of the Program or have not identified themselves as such at the time of the stay, the points will be accumulated exclusively in the account of the Holder of the reservation for the corresponding points to the Holiday Home included in the Program that has been occupied by the Holder of the reservation, without the possibility of rectification.

7. Obtaining and redeeming points and other benefits by contracting with third parties adhered to the Program

Holders may consult the particular conditions that apply to obtain or redeem points through this Program by entering the Cozy Loyalty Rewards section on our website www.cozypuntacana.com.

Holders may also redeem their points in the different promotions that are in force at all times, understanding that the points are not exchangeable with promotional rates.

Once the holders have redeemed their points, these points cannot be recovered or reimbursed to his account if he subsequently cancels said redemption of points.

8. Additional benefits of the Program

When a Cozy Loyalty Rewards Holder, in a consecutive twelve (12) month period, earns points on more than 150 nights booked in our vacation homes in this program, they obtain the following benefits that will last for the next twelve (12) months.

9. Points claim system

The Holder may make the corresponding claim by sending a message to our e-mail customerservice@cozypuntacana.com, having to indicate, in any case, the confirmation number of the visit or the contracted service on which the claim is made, and contributing in copy of the invoice at all times.

In all these cases, the Owner's responsibility will be limited to correcting the error as soon as the legitimacy of the claim made by the Owner is evidenced in accordance with the provisions of the Terms and Conditions of this Program in force at the time of the claim. . In telephone communications, the Holders must prove their identity by answering the personal identification questions that are formulated by the service operator.

Said claims are subject to an expiration regime and, therefore, may be formalized within a maximum period of 3 months from the date of check-out of the stay or the end of the contracted service; After said period, no claim for possible points not assigned will be admitted, the Holder expressly waiving to make any claim to that effect.

10. System for acquiring additional points

The Holder has the possibility of acquiring points, limited to the annual maximum established in this regard in the Program at the time of the purported acquisition.

11. Redemption of points for stays

Holders can always exchange their points for stays in our Cozy Holiday Homes included in the Program and the cancellation policies to be applied will be those established in the reservation itself.

No stay or contracting of services paid through the redemption of points will be accepted if there is no prior reservation in our own channel www.cozypuntacana.com.

The redemption of points for stays in our Cozy Vacation Homes participating in the Program can only be made by redeeming a minimum of 2,000 points per stay, without prejudice to the fact that this figure may be revised or modified by the Owner at any time.

Once the check-in has been carried out on a reservation made by redemption of points, it cannot be modified, therefore, if the Holder wishes to shorten the stay, the holder will lose their points for the remaining nights. In case of extending their stay, they must make a new reservation for those days. If the reservation is made for a period after the expiration of your points, you will not be able to modify the reservation, and the points will not be able to be recovered.

Extra consumer services cannot be paid with points.

As soon as the affiliation of one of our Cozy Vacation Homes to the Cozy Loyalty Rewards Program ceases, you will no longer be able to use or accumulate points for or for your stay at said Vacation Home and the special offers will no longer be valid for this Vacation Home. automatically. It will be the responsibility of the Holder to verify through email: customerservice@cozypuntacana.com, the affiliation or not of the Vacation Home in which he intends to generate or use the points of the Program.

12. Promotions and Promotional Points

In the event that there are promotions of points, the specific terms and conditions of each promotion will apply.

The promotional points are not transferable to other holders and in the case of transfer to other programs it will depend on the conditions of each promotion

Each of the promotions may be linked to a specific expiration date indicated in the conditions of the promotion. After the expiration date of the points, they will expire and will be withdrawn from your account without prior notice, the Holder renouncing to make any claim in this regard.

13. Transfer of points

The transfer of points between Cozy Loyalty Rewards accounts of different Holders can be made at any time by email: customerservice@cozypuntacana.com. It will always be the Donor Account Holder who requests the transfer of their points, not admitting any request from another person other than the same.

The points transferred, may not be reimbursed back to the accounts of the Cozy Loyalty Rewards Holders. The points transferred or transferred to another Holder, in no case will be taken into account, in order to consider the enjoyment of the additional benefits for permanence in the Program.

The transfer or proposal of it, by any title, of points through different pages / forums / social networks is prohibited.

In the event of the death of the Holder, their account will be canceled, but the points accumulated in it may be transferred to the heir of the deceased Holder who proves to the satisfaction of the Owner his condition as heir and holder of the Program at the time of the Death of the Holder. 14. Unsubscribe request by the holder

At any time, the Holder may unsubscribe as the holder of the Cozy Loyalty Rewards Program. For this, the Holder must communicate in writing via email: customerservice@cozypuntacana.com. Said voluntary cancellation will imply the loss of all their points and benefits automatically at the same time that their account is inactivated and they lose the status of Holder.

To attend the requested withdrawal, the Property may request documentary proof of the applicant's interested party status.

15. Expiration of Points and account cancellation

The points accumulated by a Holder in their account, including promotional ones, will expire after a period of inactivity of more than 36 months from the date of the last obtaining or redemption movement. In the event of account cancellation, all points will be forfeited, including promotional ones.

Notwithstanding other assumptions previously provided in these Terms and Conditions, the Owner may terminate a Holder and automatically and immediately cancel their account in the event of (i) breach of the current terms and conditions of the Program, ( ii) breach of their general obligations as visitors, especially those related to the payment of services and accommodation, (iii) have been warned for carrying out inappropriate behavior or for notoriously altering the ordinary activity of visitors or employees during any of their stays, (iv) occur circumstances of force majeure or due to legal, governmental or other impositions that make the cancellation of the Program necessary and, finally, (v) reasons of the Owner's business strategy.

The cancellation made, disables the expelled Holder to apply again and henceforth for their adhesion to the Program.

In each and every one of the cases listed above, this Program being free for the Holder, they expressly waives to claim damages from the Owner and / or the Manager for the cancellation of their account and / or, where appropriate, his own. Program.

16. Disclaimer

The Owner does not assume any type of responsibility in relation to the products and services marketed or provided by third parties, without being responsible in relation to loss of prizes, correspondence, incorrect addresses, delays in receiving prizes, etc .; nor the theft or redemption of unauthorized points or the use of a Prize as a consequence of circumstances beyond the ordinary operation of the Program.

The Owner reserves the right to correct or correct any errors, both typographical, price, points, descriptions, among others related to the Program.

The Owner is not responsible for lost or delayed correspondence in the physical or electronic mail of the Holder, nor for errors of description, typographical or rate printed on the material sent to the Holders, reserving the right to correct them and may be consulted. on the web www.cozypuntacana.com

17. Protection of Personal Data

18. Modifications to the Program. Cancellation, if applicable, of the Program

The Owner reserves the right to cancel the Program at any time for commercial reasons related to the company's internal operations. This fact will be notified to the Holders, who, as of the notification date, have three (3) months to redeem all the points that appear in their account. After this period, all the points accumulated by the holders will be automatically canceled, without the right to any compensation in favor of the Holder thereof, and from that moment they cannot claim anything from the Owner or any company in their group for this reason. . The Program will be canceled without prior notice or liability, the provisions of this paragraph not being applicable, if at any time there are circumstances of force majeure or legal impositions that prevent its continuity or development.

19. Integrity

If any provision of these Terms and Conditions or the application of any provision is considered illegal, invalid or unenforceable, in whole or in part, under any Law, said provision or its part will be understood as not put but the legality, validity and applicability of the Terms and Conditions and the application of said provision to other persons or in other circumstances will not be affected. This clause will have no effect if the fundamental nature of this Contract is altered or if it is contrary to public order.

20. Applicable law and jurisdiction

The Terms and Conditions of the Cozy Loyalty Rewards Program are governed by the regulations in force in the Dominican Republic in this matter and, for any question that may arise in relation to the interpretation and application of these General Terms and Conditions, the parties, expressly waive to the jurisdiction that may correspond to them, they expressly submit to the jurisdiction of the courts and tribunals of the La Altagracia Province, in the Dominican Republic.
